Simmons Rewards Visa Signature® Program Terms & Conditions

General

These Terms & Conditions describe how the Simmons Bank Rewards Program works for the Simmons Rewards Visa Signature Card account and is an agreement between you and Simmons Bank. You agree that use of your account or any feature of this program indicates your acceptance of these Terms & Conditions. In these Terms and Conditions, “we”, “us” and “our” refer to Simmons Bank; “you” and “your” refer to each account holder who is participating in the Simmons Bank Rewards Program.

Participation is restricted to U.S. account holders of the Simmons Rewards Visa Signature Card. Fraud or abuse relating to the accrual of points or any redemption may result in forfeiture of accrued points, as well as cancellation of participation/membership in the Programs. Membership will automatically be renewed each year as long as your account is in good standing, unless the account holder notifies us of their desire to end participation in the Simmons Bank Rewards Program. Simmons Bank Rewards Program is void where prohibited by federal, state or local law.

Earning Points

Account holder will earn one and a quarter (1.25) points per net dollar purchase made on their account – excluding cash advances, travelers check purchases, balance transfers and access checks. Points do not accumulate for fees of any kind, such as finance charges, late payment fees, over limit fees and related service charges, unauthorized charges and ATM transactions. Points cannot be earned until a rewards account is assigned. No retroactive credit will be given. Points may not be combined from different reward accounts to earn a reward. Points cannot be used with other frequency or reward programs.

Your rewards points balance will be updated monthly. There are no monthly or annual maximums for point accumulation. Points may take up to 60 days to post following a qualifying purchase. Points are considered earned as posted to the redemption system. Points are not transferable. Points earned are equal to the sum of billed purchases during the period, less any refunds or returns. Points expire three (3) years after the last day of the month in which they were earned. Points are redeemed in a first in first out basis.

We reserve the right to alter, change, or terminate the program at any time without notice. We reserve the right to determine what is a qualifying transaction, make any exceptions, and adjust points at any time prior to or following posting and/or redemption.

How you could be prohibited from earning or using points:

We may temporarily prohibit you from earning points or using points you’ve already earned:

  • If you don’t make the minimum payment on your account within 30 days of the due date.
  • If we suspect that you’ve engaged in fraudulent activity related to your account or the program.
  • If we suspect that you’ve misused the program in any way, for example:
  • by buying or selling points
  • by selling, or participating in the sale or exchange of, gift certificates, travel or other items of value obtained through use of points
  • by repeatedly opening or otherwise maintaining credit card accounts for the purpose of generating rewards
  • by manufacturing spend for the purpose of generating rewards
  • by moving or transferring points to an ineligible third party or account
  • If we suspect you’ve misused, in any way:
  • a third-party merchant or service provider program with which points may be used under this program
  • a frequent travel program to which points may be transferred under this program, if applicable

You may begin earning and using points again in the next billing cycle after your account becomes current or when we no longer suspect fraud or misuse of the account or program.

How you could lose your points:

You'll immediately lose all your points if your account status changes or your account is closed for any of the following reasons:

  • You don’t make the minimum payment on your account within 60 days of the due date
  • You fail to comply with this or other agreements you have with us
  • We believe you may be unwilling or unable to pay your debts on time
  • You file a petition as debtor in any bankruptcy, receivership, reorganization, liquidation, dissolution, or insolvency proceeding, or are the subject of an involuntary petition in any such proceeding
  • We believe that you’ve engaged in fraudulent activity related to your account or the program
  • We believe that you’ve misused the program in any way, for example:
  • by buying or selling points
  • by selling, or participating in the sale or exchange of, gift cards, travel or other items of value obtained through use of points
  • by repeatedly opening or otherwise maintaining credit card accounts for the purpose of generating rewards
  • by manufacturing spend for the purpose of generating rewards
  • by moving or transferring points to an ineligible third party or account
  • If we suspect you’ve misused, in any way:
  • a third-party merchant or service provider program with which points may be used under this program
  • a frequent travel program to which points may be transferred under this program, if applicable


We won’t reinstate points you lose, unless we’ve made an error.

If your account is closed for any other reason, you’ll have at least 30 days from the date your account is closed to use your points, as long as you don’t lose them for any of the reasons described in this agreement. If you don’t use your points during that time, you’ll lose them.

If we decide to cancel the program, you’ll have at least 30 days from the date we cancel the program to use your points, as long as you don’t lose them for any of the reasons described in this agreement. If you don’t use your points during that time, you’ll lose them.

If your account is closed as a result of your death, your points will be automatically redeemed for cash in the form of an account statement credit.

Rewards Redemption

The account must be open and in good standing and the outstanding account balance must not be in excess of the approved credit line, in order to redeem points. Reward options may include cash back, airline tickets, gift certificates, merchandise, hotel stays, and car rentals and may change periodically and without notice. Additionally, you may use points to pay annual membership fees. The latter is restricted to one time per calendar year with the credit to be shown on the account holder’s billing statement within 1 to 2 billing cycles. For redemptions, inquiries, and updates, you may call Simmons Bank Rewards at 1-866-469-3632. Hours of operation are:  Monday – Sunday 9:00 am to 9:00 pm EST. All travel agency services and gift card and certificate distributions are completed by TSYS Loyalty (“TSYS”).

Cash Back

  • Statement Credits: Statement credits will post in the form of a credit to your account within 10 calendar days of the redemption. This credit posts to the account from which the points are redeemed. The statement credit will apply towards the balance but does not count as a payment. You are still responsible for the minimum monthly payment in any given month that a cash back redemption is applied against your card balance.
  • Direct Deposit: Points can be redeemed towards a deposit into a Simmons Bank checking or savings account. If the selected account information is entered incorrectly, the receiving bank may reject the direct deposit request which will result in the points being returned back to your rewards point balance. However, Simmons Bank is not responsible for any losses you may suffer as a result of any typos or keystroke errors that you make in entering account information.

Travel Packages

  1. All travel packages must be booked a minimum of 60 days prior to travel date or account holder will incur additional fees.
  2. Traveler must meet the eligibility requirements established by the travel provider. Travel packages may only be booked through the Rewards Customer Service Center.
  3. Travel packages may not be combined with upgrade certificates, frequent traveler promotions or other reward programs, promotional or discount certificates/vouchers, Internet fares, companion fares, group travel, convention fares or special rate programs.
  4. Travel packages that have been booked may not be cancelled and are not eligible for any refund in part or whole. No interim price reductions will be considered or offered once the booking has been completed.
  5. After booking, any additional special handling may result in additional fees.

Cruise Rewards

  1. All cruise redemption requests must be made at least 60-days prior to sailing. All cruise awards are based on double occupancy for a cabin. At least one member sailing must be 21-years of age or older.
  2. All cruise awards are non-refundable. Changes may be made up to 90-days prior to sailing (120 days for holiday and special event cruises) for a $100.00 change fee, plus any fees imposed by the cruise line. Changes or cancellation under 90-days (120 days for holiday and special event cruises) may result in forfeiture of award, or additional fees. In addition, if a reservation is not canceled, and account holder or recipient is a no-show, the travel award is void.
  3. Simmons Bank and TSYS are not responsible for the performance of the cruise line.

Airline Rewards

  1. There are no blackout dates. Travel is subject to availability. Participating air carriers are subject to change without notice. All airline rules and restrictions apply (check requirements when booking). Tickets may be purchased in any individual’s name.
  2. Miscellaneous costs, including baggage, airport/airline fees and surcharges, government-imposed fees, gratuities, insurance and airline amenities are your responsibility. Your tickets will be non-refundable and non-transferable.
  3. All tickets are issued as electronic tickets. All tickets must be issued at the time of booking and reservations will not be held. Before completing your order please confirm that all information is accurate. All airline redemptions are non-refundable and non-transferable.
  4. You may elect to have the Rewards Service Center book non-rewards airline tickets through a major airline carrier providing that the fares, schedules and ability to generate a ticket are possible through the Rewards Service Center. This service will be subject to a service fee at time of booking.
  5. All travel itineraries and supporting documentation will be sent via email. Reservations for tickets also exclude the use of charters, wholesalers, consolidators, and any internet fares that are not published, not available through the Rewards Service Center, and/or not available for ticketing through a certified travel agency.
  6. Once Point Rewards are redeemed, the transaction cannot be reversed. If changes to an itinerary are necessary later, you or another authorized participant may contact the Rewards Service Center with the request up to 3 days prior to the travel date.  Based on airline requirements, changes may require additional costs such as airline penalty fees, increased fares, and service fees. Most airlines will not allow traveler name changes. 
  7. Flight reservations should be re-confirmed by the traveler at least 72 hours prior to departure. All reservations are subject to the rules, restrictions and conditions of the service provider, which include exclusions and limitations of liability.
  8. The traveler should have valid government-issued photo ID upon airport check-in. For travel requirements (domestic and international) please visit:  https://travel.state.gov
  9. Airline ticket awards may not be used in conjunction with any type of coupons, vouchers, other mileage programs or companion fares.
  10. Simmons Bank and TSYS are not responsible for communication of airline schedule changes. Neither Simmons Bank nor TSYS is responsible for the performance of the airline.

Car Rental Rewards

  1. Advance reservations are recommended for reward rentals.
  2. Renter will be required to execute a rental agreement at time of rental. Renter must provide a major credit card at the time of rental (check cards may not permitted).
  3. Rewards do not include taxes, insurance, mileage fees, airport fees, extra drivers, optional service charges such as refueling or any other fees or charges imposed by rental location and/or company.
  4. Some blackout dates may apply.
  5. The rental car company may inquire about a renter’s driving record at time of rental to determine rental eligibility.
  6. Participating rental card service providers and reward offerings are subject to change without notice.
  7. You may use points, points plus cash or all cash for car rental reservations with select car rental companies as shown available on the rewards website or when making reservations directly with a rewards agent.
  8. Car reservations will be prepaid at the time of booking and payment for costs not covered by the use of points will be made to the credit card on file. Car rental charges will appear on the credit card statement as “Card Member Services”.
  9. Renter will be solely responsible at the time the rented vehicle is returned for all additional rental days and for any and all taxes and other charges not included in the daily rental rate.
  10. Each Renter (and any person identify on the Rental Contract as an “Additional Authorized Driver”) must possess a valid driver’s license issued by the state or province in which such person resides, be age 21 or older (or 18 or older where required by law; and 25 or older for luxury, large sport utility, and 12 and 15 passenger vans), and meet all other qualifications of the applicable Rental Car Company at the applicable renting location.
  11. Reservations for all car groups are subject to availability. Vehicles may only be reserved by vehicle class and not by vehicle make or model. In the event Renter reserves a vehicle and the class of vehicle is not available at the time of rental, the applicable Car Rental Company shall provide the Renter with a vehicle in a higher class, subject to availability, at the same rate as the vehicle class which was reserved.
  12. Performance by the car rental company of car rental services shall be under a standard rental agreement in effect at the time of rental, which must be executed by the Renter at the time of pickup.
  13. Renter will use the Rented Vehicle only for personal or routine business use and operate the Rented Vehicle only on properly maintained roads and parking lots. Renter will comply with all applicable laws relating to holding of licensure to operate a motor vehicle.
  14. Neither Simmons Bank nor TSYS is responsible for the performance of any car rental company provider.

Hotel Rewards

  1. You may redeem Rewards for over 500,000 hotels worldwide Hotels; these may only be booked through the Rewards Service Center. You must meet the eligibility requirements established by the hotel provider at the time of booking.
  2. Hotel rates do not include Resort Fee’s, if applicable, which are payable directly to the hotel at the time of check-out.
  3. Most hotel rates allow cancellation with a minimum of a 24-hour notice. Please see the specific hotel/rate cancellation policy at the time of booking.   Cancellations may include penalties and a cancellation service fee may apply.  Refunds for cancellations may take up to 3 to 4 weeks.
  4. Hotels do not allow changes to dates, names, room type, and number of occupants once booking is complete. Changes will result in a cancellation of the current reservation, adhering to the hotels cancellation policy and rebooking at the current room rate and room availability.
  5. Neither Simmons Bank nor TSYS is responsible for the performance of any hotel provider.

Tours and Attractions

  1. Tours and attractions are fulfilled by independent operators and subject to the operator’s own rules. Voucher requirements for each operator displays on the redemption summary page during the redemption process at www.simmonsbankrewards.com for operators that we have the information for. However, the information is provided for convenience only and may not be accurate. We recommend contacting the applicable operator to confirm their voucher requirements. The requirements that may be listed are:
    1. Paper Voucher Only: Our local operator requires you to present a printed copy of this voucher on the day of your activity. You may be refused entry if you do not present a printed copy of your voucher.
    2. e-Voucher: The local operator accepts both printed and electronic vouchers (e-vouchers). If you travel with a mobile device, simply show your Photo ID and present your e-voucher on your Smartphone or tablet on the day of identity (valid ID for the lead traveler).
    3. Voucher Not Required: You can present a paper or electronic voucher for this activity, or you can simply present the lead traveler’s Photo ID. Our local operator has your reservation on file and only requires proof of any hotel provider.
  2. Cancellation Policy:  The cancellation policy will vary by tour/activity. In general, no cancellation fee will be assessed if you cancel at least seven (7) calendar days in advance of the scheduled departure. If you cancel between three (3) and six (6) calendar days in advance of the scheduled departure, a cancellation fee equal to 50% will be assessed. If you cancel two (2) or fewer calendar days before the scheduled departure, a cancellation fee equal to 100% will be assessed.

Retail Gift Certificate/Card Rewards

  1. Gift certificates/cards (“Certificates”) may not be combined with any other promotional offers.
  2. Certificates are valid at participating merchants only through the expiration date printed on the Certificate.
  3. Certificates must be submitted at redemption, and no photocopies of Certificates will be honored.
  4. Fulfillment of the Certificates is the sole responsibility of the participating merchant.
  5. Use of Certificate is subject to any additional restrictions listed on the Certificate.
  6. Certificates are not valid toward previous purchases and cannot be used as payment on existing account balances with either the participating merchant or Simmons Bank. Certificates have no cash value and may not be redeemed for cash or its equivalent. Any unused portion will not be returned as cash unless a certificate states otherwise.
  7. Certificates are not refundable or exchangeable and are not replaceable in the event of loss or destruction, after issuance.
  8. Certificates are transferable unless otherwise noted on the Certificate.
  9. Certificates are void where prohibited by law.
  10. Unless otherwise stated on the Certificate, Certificates for rewards offered do not include any federal, state, or local taxes, which are solely your responsibility.
  11. Simmons Bank and TSYS are not responsible for the problems or defects of any merchandise purchased using a Certificate or for failure of merchant to perform because of bankruptcy, insolvency or any other reason.

Merchandise

  1. Merchandise rewards are offered and provided by independent manufacturers.
  2. Merchandise rewards include applicable sales tax and shipping and handling (via First-Class Mail or ground delivery or motor freight service within the continental U.S.).
  3. Merchandise will not be delivered to PO, APO, or FPO boxes. Merchandise will be shipped to the account holder’s statement mailing address unless otherwise authorized by us.
  4. For security reasons, parcel or motor freight couriers may contact the account holder to arrange delivery of merchandise. It is the responsibility of the account holder to respond to the courier in a timely and reasonable manner to facilitate the delivery process.
  5. Additional shipping and handling fees for merchandise returned to vendor due to the account holder’s failure to make delivery arrangements are the responsibility of the account holder.
  6. Please allow four to six weeks for delivery from time of order. The account holder will be notified of any delays by postcard, letter, or phone call.
  7. All merchandise reward orders are subject to product availability and Simmons Bank reserves the right to substitute merchandise of equal or greater value. The account holder will be notified if the merchandise reward ordered is not available and, if known by Simmons Bank, when it will become available. Simmons Bank reserves the right to alter or substitute any or all merchandise rewards at any time without prior notification.
  8. Returns are only accepted for merchandise that is damaged, defective, or incorrectly shipped. Notification of same must be made within 48 hours of delivery and must be returned within 30 days for credit or shipment of replacement item. If the item is damaged or defective, please contact Simmons Bank to report the problem and obtain assistance.
  9. The manufacturer’s warranty applies to all merchandise rewards. Simmons Bank and TSYS make no express or implied representation or warranty and will not be liable for injury, damage, loss, or expense resulting from your acceptance of use of the reward or from a reward’s defect or failure. Simmons Bank and TSYS disclaim any implied warranty of merchantability or fitness for any intended use or particular purpose.

Pay Me Back

  1. Rewards points may be redeemed through the redemption category Pay Me Back for transactions that have posted to your account in the past 90 days. Pay Me Back is valid for up to three (3) transactions that total a minimum of $25.00.
  2. When logged into www.simmonsbankrewards.com, you may select your transaction(s) for which you desire to use the Pay Me Back reward. The Pay Me Back Rewards will post in the form of a statement credit to your card account within 10 calendar days of redemption. The credit will be identified on your statement as “Rewards – Pay Me Back” and will post to the card account from which the points were redeemed.
  3. Receiving a Pay Me Back rewards statement credit will not affect any return credit you are otherwise entitled to receive for any transaction you select to use the reward for. 

Other Important Information You Should Know:

Points aren’t your property and have no cash value. You can’t transfer or move points unless expressly provided for in these Terms & Conditions. Additionally, points can’t be transferred for any reason or by any operation of law, including, but not limited to, inheritance, bankruptcy, merger, selling of assets, or divorce.

Your participation in the program may result in miscellaneous income received from Simmons Bank and we may be required to send you, and file with the IRS, applicable US tax forms for the year in which you participate and are awarded the benefits of this program. You are responsible for any tax liability related to participating in this program. Please consult your tax advisor if you have any questions about your personal tax situation.

We may assign our rights and obligations under this agreement to a third party, who will then be entitled to any of our rights that we assign to them.

We’re not responsible for any disputes you may have with any authorized users on your account about the program.

 Simmons Bank and its third-party service providers and their respective affiliates, directors, officers, employees, agents or contractors make no representations or warranties, either express or implied, including, those of merchantability, fitness for intended use or a particular purpose and otherwise arising by law, custom, usage, trade practice, course of dealing or course of performance. You release Simmons Bank, its third-party service providers, and their  respective affiliates, directors, officers, employees, agents and contractors for all activity in connection with the program, including but not limited to, use of the program and any redemption for or purchase of products or services through the program.

You agree to indemnify and hold Simmons Bank and its third-party service providers and all of their respective affiliates, directors, officers, employees, agents and contractors harmless from and against any loss, damage, liability, cost, or expense of any kind (including attorneys’ fees) arising from your or an authorized user’s: use of the program, any fraud or misuse of the program, violation of this agreement and/or violation of any applicable law or the rights of any third party.

The merchants and third-party service providers that participate in the program are not affiliated with us and are not sponsors or co-sponsors of the program. All participating merchant and third-party service provider names, logos, and marks are used with permission and are the property of their respective owners.             

Participating merchants and third-party service providers are subject to change without notice.

Participating merchants and third-party service providers are responsible for the quality and performance of any products or services they provide. Simmons Bank is not responsible for any aspects of the products and services provided by participating merchants or third-party service providers.

The program is void where prohibited by federal, state, or local law.

This agreement and use of the program is governed by federal law, as well as the law of the State of Arkansas, and will apply no matter where you live or use the program.

We may enforce the terms of this agreement at any time. We may delay enforcement without losing our right to enforce this agreement at a later time. If any term of this agreement is found to be unenforceable, we may still enforce the other terms.
