Terms and Conditions for Check Cashing Services
These terms and conditions apply to checks cashed by Simmons Bank (“Simmons”, “we”, “our”, or “us”) at a Simmons Bank branch. By cashing a check at a Simmons branch, you agree to these terms and conditions.

Eligible Checks.
Check cashing services are generally available for checks drawn on us and made payable to only one individual. You are responsible for properly indorsing the check. There is no limit on the types or amounts of checks that are eligible for this service. However, we reserve the right to refuse to cash any check if there are insufficient funds in the account on which it is drawn or if we believe, in our sole discretion, that cashing any check could introduce unreasonable risk of loss to Simmons. We also reserve the right to refuse to cash any check for any other reason in our sole discretion, including, but not limited to, checks made payable to businesses, checks made payable to more than one party, checks drawn on another financial institution, checks presented for payment by an agent of the payee rather than the payee of the check, and actual or suspected fraud. We may require you to present a form of government-issued identification at the time of the transaction.

Fees
There is a $10 fee per check cashed for a non-Simmons customer. For purposes of these terms and conditions, “non-Simmons customer” means any person who does not have an open and active deposit (including CDs), wealth management, credit card, or loan account or safe deposit box at Simmons at the time the check is cashed.

Indemnification and Reimbursement of Simmons for Forged, Counterfeit, Altered, or Returned Checks and Improper Indorsements.
TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AGREE TO INDEMNIFY, REIMBURSE, AND HOLD US HARMLESS FROM AND AGAINST ANY LOSSES, CLAIMS, DAMAGES, OR EXPENSES WE INCUR WHICH ARISE FROM OR ARE IN ANY WAY RELATED TO A CHECK CASHED BY YOU WHICH IS LATER RETURNED TO US (OR FOR WHICH A CLAIM IS LATER MADE AGAINST US) DUE TO ACTUAL OR ALLEGED FORGED, UNAUTHORIZED, OR MISSING INDORSEMENT; CHECK ALTERATION; COUNTERFEIT CHECK; ENCODING ERROR; INSUFFICIENT FUNDS; OR OTHER REASON OR CLAIM.

Other Terms and Conditions.
If you have a deposit account with Simmons, these terms and conditions supplement, and do not replace or otherwise affect, the “Terms and Conditions of Your Account” (along with the other disclosures and other documentation applicable to the account). Note that, pursuant to the disclosure titled “Your Ability to Withdraw Funds,” if we cash a check for you that is drawn on another bank, we may withhold the availability of a corresponding amount of funds that are already in your account. Those funds will be available at the time funds from the check we cashed would have been available if you had deposited it. These terms and conditions are governed by the laws of the state of Arkansas. We may change these terms and conditions at any time by posting an updated version on our website.
